A Mundelein chiropractor is being sued in a federal court for insurance fraud Tuesday after he allegedly overbilled an insurance company more than $300,000 for services he never performed.

Aetna Life Insurance Company filed the five-count insurance fraud lawsuit in U.S. District Court against Andrew W. Carr. D.C. and Coast Capital Finance -- a New Jersey company that bought claims from Carr.

According to the lawsuit, Carr was operating Community Physical Medicine and Rehabilitation P.C., in Mundelein, when several of his clients contacted Aetna in 2007 claiming they were billed by Carr for services he never performed. In at least one instance, an Aetna member was not living in Illinois during the billing dates submitted, and in another case he billed for several family members in 2007 for services he never rendered.

An investigation by Aetna showed Carr and Coast Capital Finance, a company that bought claims for an upfront fee from Carr, unjustly received $333, 000, the lawsuit claims. The lawsuit said Carr contacted Aetna and said he would begin to repay the amount overpaid in the claims.

The five-count lawsuit claims Carr and Coast Capital Finance committed insurance fraud, negligent misrepresentation, unjust enrichment, and civil conspiracy.
