Forty Fort chiropractor accused of obtaining more than $100,000 through fraudulent claims

Authorities allege a Forty Fort-based chiropractor charged Tuesday with felony insurance fraud had been using another doctor's information to bill for services he never received.

Dr. Gary Peter McGee, 41, of Christian Street, Nanticoke, fraudulently obtained $106,217 through 212 fraudulent claims to Blue Cross of Northeastern Pennsylvania from 2004 to 2007, according to the Lackawanna County District Attorney's Office, part of the NEPA Insurance Fraud Task Force.

Due to the five-year statute of limitations, McGee is only being charged with taking $83,980 through 74 of the false claims, a press release from the task force states.

McGee did business at 1144 Wyoming Ave. as Wyoming Family Chiropractic, leasing office space from Dr. Paul Mahler.

It was a rubber stamp with Mahler's name and Mahler's Blue Cross-Blue Shield provider ID that McGee used, without permission, to forge the illegal paperwork, authorities said.

According to arrest papers, an independent review of McGee's medical records indicated they did not look legitimate and did not match the number of services billed.

Mahler told investigators he had treated McGee weekly with adjustments, trigger points and electrical stimulation when he first took over the practice, but stopped because he thought it would be a conflict of interest.

Mahler said McGee does not work for him, but was an independent contractor who had an agreement to use Mahler's billing software.

When investigators presented Mahler with McGee's medical records for 2004-07, they learned Mahler had not filled them out. Mahler found his copies of McGee's medical records were missing.
